Developer sues lands registrar over lease titles

Tamarind Properties, the developer of 208 housing units in Mavoko, has accused the registrar of lands of delays in processing its lease titles, which has seen it default on repayment of a Sh200 million loan borrowed from KCB.

The developer has asked the High Court to compel the Chief Land Registrar to issue subleases for 69 housing units, arguing that it has completed a Sh2.6 million fee for licences and rates for the land, but has not been issued with the subleases. Tamarind says this has slowed down the sale of the units, which has in turn led to the suit lodged against it by KCB.

“Tamarind has not received any official communication from the Commissioner of Lands on any specific reasons for the delay in registering the subleases and charges,” said Joe Mungai, Tamarind’s MD.
