A chief magistrate’s court is on Friday expected to rule on a petition seeking to revoke a bond issued to Gatundu South MP Moses Kuria, currently facing hate speech and incitement to violence charges.
Milimani Principal Magistrate Theresa Nyangena said she would give a ruling after hearing both Mr Kuria and the prosecution on the matter.
The Director of Public Prosecutions (DPP) had last month filed an application to have the MP’s Sh2 million bail revoked over alleged inflammatory remarks he is said to have made against those who opposed the National Youth Service (NYS) projects.
According to the DPP’s application the bail was granted last year on condition that Mr Kuria desists from uttering inciting statements.
His lawyer Danson Mungatana however told the magistrate that Mr Kuria had presented himself to court whenever needed and there had been no change in circumstances to warrant the bail revocation.
“The prayers sought by the application to revoke the bail have the effect of prejudicing the accused as if there is already a presumption of guilt even before the case is heard,” he said.
