Kenya's retired President Daniel arap Moi will move to the Supreme Court to challenge an order directing him to vacate a 100-acre farmland adjacent to Moi High School Kabarak.
On Thursday, Justices Martha Koome and Hannah Okwengu gave the former President six months to vacate the parcel or be evicted.
The judges also ordered him to meet the costs of the suit against Mr Malcolm Bell.
However, the principal of Moi High School Kabarak, Henry Kiplagat said in statement that the school had instructed its lawyers to proceed and file an appeal at the court of the last resort.
Mr Justice Muga Apondi had in 2006 allowed the school to continue occupying the land claimed by Mr Malcolm Bell, saying that it had acquired the title deed by adverse possession. Mr Bell sued the former president for allegedly trespassing on his land.
