NSSF threatens to evict Tassia plot owners

The National Social Security Fund (NSSF) has swiftly moved to demand Sh5 billion from Tassia residents following dismissal of a case filed by the property owners.

NSSF said those will not pay would be evicted or have their structures demolished. The affected plots are in Tassia phases 2 and 3.

Plot owners are expected to pay Sh920,000 each to cater for the infrastructure development, survey and physical planning fees, engineering and design costs and processing of individual title deeds.

“NSSF shall not hesitate to invoke its rights under the Eviction Order issued under Civil Suit No 529 of 2002 to carry out evictions and demolitions for buyers who will not have cleared the infrastructure development cost,” said a notice signed NSSF managing trustee Richard Lang’at.

On September 4, Justice Weldon Korir ruled the plot owners had, when buying the plots, agreed to meet the cost of infrastructure once approved by the county government.

“The county government of Nairobi has made development of necessary infrastructure and services mandatory for the final approval of the Physical Development Plan, which approval would then pave the way for the processing and issuance of individual titles,” added the statement.

The plot owners had claimed in court NSSF breached a contract when it increased prices of the plots.
