Regulator on the spot over secure radio frequencies

The High Court in Nairobi has ordered the Communications Authority of Kenya (CA) to disclose how frequencies exclusively reserved for KDF, the police and the national intelligence were awarded to a radio company.

Justice Isaac Lenaola directed that the regulator be enjoined in a case pitting an activist against Tetra Radio requiring them to give proof of how they came to own the frequencies.

“I certify this suit as urgent and order that the CA be party to the suit. All parties should file their replying papers by July 23 when the case will be mentioned,” Judge Lenaola said. 

Transition period

Mr Okiya Omtata claimed the licence was issued during a transition period when the Moi regime handed power to the Kibaki government in 2002 raising authenticity and transparency issues.

He said the frequencies which are wholly reserved for the security forces were issued corruptly to Tetra Radio.

The activist asked the court to order the firm to disclose documentary evidence to back up their claim of frequency ownership.

In his affidavit, Mr Omtata claimed the radio won the commercial trunked radio communication operator licence tender at a bid of Sh452.4 million.

The case resumes hearing next week.
