Justice Musinga, who is currently handling two high-profile commercial disputes involving CMC Motors Group and the Sh240 billion Tatu City project, will face the vetting panel on September 20.
He will be interviewed the same day with Justice George Dulu, Reuben Chirchir, the chief executive of the Judges and Magistrates Vetting Board, announced Thursday.
The judge has already determined one of the suits in which ousted CMC chairman Peter Muthoka was seeking reinstatement to the board. Mr Musinga said his restoration would not be in the interest of shareholders.
The judge is yet to determine the Sh1.5 billion compensation claim the company has lodged against Mr Muthoka. CMC Holdings and CMC Motors are seeking a refund from Andy Forwarders and its two directors, Mr Muthoka and Mr John Kivai, accusing them of defrauding the company through inflated contracts.
Mr Muthoka has sued PricewaterhouseCoopers (PwC) and its chief executive for alleging in their forensic audit that he overcharged CMC by more than Sh1.5 billion.
Mr Muthoka has also filed a separate application asking Mr Musinga to disqualify himself from the case for having made findings that would prejudice the case.
Mr Musinga is also handling the Tatu City project in which minority and majority shareholders are fighting over the development of a city of 62,000 residents in Kiambu County financed by Moscow-based investment bank Renaissance Capital.
On August 3, Mr Musinga lifted court orders to stay proceedings of the multiple suits, paving way for determination of winding up petitions filed against the company by minority shareholders.
