DPP wants police sued for post poll children deaths

Director of Public Prosecutions (DPP) Keriako Tobiko has supported disciplinary measures against top police officers over the killings of a girl and a baby in election-related violence and need to compensate the families of the two children.

The chief prosecutor said that four top commanders who served in Kisumu when six-month-old Samantha Pendo died in a police operation should face disciplinary action for negligence and making it difficult to identify officers under their watch who committed criminal acts.

The four commanders cited by IPOA are then Kisumu County Commander Titus Yoma, Kisumu East OCPD Christopher Mutune, Kisumu Central OCS John Thiringi and Benjamin Kosgei Koima the Kisumu Central sub-County Administration Commander.

Baby Pendo was teargassed and clubbed by police officers who invaded their home in Kisumu in search of protesters.

The office of the DPP said a public inquest should be formed to investigate the death of Stephanie Moraa, an eight-year-old girl in Mathare slum,Nairobi, who died after being hit by a stray bullet as police officers fired to disperse protesters on August 12 when Presidential election results were announced.

Mr Tobiko supported Independent Police Oversight Authority (IPOA) recommendation that the families should sue the National Police Service (NPC) for compensation.

“The family of the deceased should pursue civil proceedings against the National Police Service (NPS) for compensation should the commission fail to compensate them,” said the office of the DPP.

Human rights groups say at least 66 people have died in bloodshed associated with the August election, which was later annulled by the Supreme Court, and in unrest surrounding the re-run of the presidential vote last month.
