Driver to pay family Sh2.5m after kin dies in road crash

The court has offered Sh2.5 million compensation to the family of a casual worker who succumbed to head injuries sustained in a road accident after staying in the ambulance for 18 hours.

Alex Madaga died from the injuries in 2015 after two private hospitals turned him away for lack of Sh200,000 and the Kenyatta National Hospital  could not admit him due to lack of bed space in the Intensive Care Unit.

The owner of the vehicle that hit him, Josephine Mbuthia, and the driver, Zacheus Kuria Mungai, will pay the cash or face jail.

“The deceased was aged 37, he went about his daily chores unhindered and was full of life. He had high expectations in life being a family man and his life was suddenly cut short,” said Magistrate Gesora.

The magistrate awarded the family Sh150,000 for pain and a minimum wage compensation for 20 years amounting to Sh2,068,248.

He also awarded them Sh189,659 as special damages and another Sh150,000 for loss of life.

The man was walking along Nairobi’s Waiyaki Way near Thiongo area when a motor vehicle, with registration number KCA 189V knocked him down.
