Highways authority KeNHA to sue protesters for damaging roads

The national highways authority has expressed concern over destruction of roads during anti-IEBC protests around the country.

Kenya National Highways Authority (KeNHA) on Tuesday said demonstrators who have been burning public roads during protests will face the full force of the law.

KeNHA chair Erastus Mwongera said they will prosecute culprits who burn tyres on public paved roads during Nasa protests so as to recover repair costs.

Sh100m a kilometre

It is estimated that a kilometre of paved road cost in excess of Sh100 million to repair.

This translates to Sh100,000 per metre or Sh50,000 per cubic metre of bituminous surface repair.

“In view of the above, instances where the authority will encounter tyres set ablaze on any public paved road, we will have no option but to prosecute the culprits in courts of law and recover the cost of repair from the persons who will be found culpable for having organised the demonstrations,” he said.

The Kenya Roads Act, 2007 Section 58 (b&c) stipulates that any person who unlawfully damages or in any way interferes with any road or other properties of an authority in such a manner as to endanger the life any person commits an offence and is liable to conviction of imprisonment of a term not exceeding two years, or to a fine not exceeding Sh100,000, or both.
