The National Land Commission (NLC) has published rules to guide investigations into historical land injustices, opening doors to thousands of Kenyans who have raised the emotive issue for decades.
The National Land Commission (Investigation of Historical Land Injustices) Regulations, 2017 contained in the October 6 Kenya Gazette Supplement provide detailed procedures for lodging claim, conducting investigations, holding hearings and deciding the cases.
Under the regulations which cover historical land injustices that occurred between the June 15, 1895 and August 27, 2010, the NLC may initiate investigations or act upon request made by affected parties. Kenya promulgated a new Constitution on August 27, 2010.
“A person may lodge a claim stating description of the property, the period when the injustice occurred, particulars of the respondent, witnesses, previous recovery attempt and suggested remedy” the NLC regulations state.
The rules are set to open doors to thousands of Kenyans as almost all indigenous Kenyan communities have staked historical claim to land they consider originally theirs.
