High Court judge Enock Chacha Mwita directed that Hassan Zubeidi presents himself to the Director of Criminal Investigations to record statements that would help police with their investigations.
Mr Zubeidi faulted the DCI for persistently engaging in actions aimed at incriminating him with all manner of protracted misdeeds that affected the lender.
The High Court has temporarily stopped the arrest of Dubai Bank chairman Hassan Zubeidi.
High Court judge Enock Chacha Mwita issued the directive after Mr Zubeidi sought to stop his imminent prosecution with regard to managerial affairs of the collapsed lender.
However, the judge directed that he presents himself to the Director of Criminal Investigations to record statements that would help police with their investigations.
“In the meantime, Mr Zubeidi shall not be arrested until October 10 when this matter will come up for hearing and further orders,” said Justice Mwita.
Through his lawyer, Mr Karathe Wandugi, Mr Zubeidi had argued that his prosecution would be merely oppressive and with ill-intent.
Mr Zubeidi, who describes himself as the former non-executive director of Dubai Bank faulted the DCI for persistently engaging in actions aimed at incriminating him with all manner of protracted misdeeds that affected the lender.
He argued that he was never directly involved with administrative matters of the bank and that even the Central Bank as well as the Kenya Deposit Insurance Corporation (KDIC) unfairly opted to liquidate Dubai Bank, which has been operational since February 2000.
The financier was placed under receivership in August 2015 after it was found in breach of several banking industry regulations that had put at risk the Sh1.4 billion that savers had deposited with it.
The KDIC opted to liquidate Dubai Bank after an audit of the lender’s books found that rescue attempts would be futile.
