Nyong’o battles with kin over property

Two nephews of Peter Anyang’ Nyong’o have opened a succession battle against the Kisumu governor for excluding them from the list of beneficiaries of their grandfather’s estate.

Geoffrey Omondi Nyong’o and Kenneth Odhiambo Okuthe are also targeting Dr Nyagoy Nyong’o Bloch, a trustee of the property that Hesbon Shimei Nyong’o, the governor’s father, left behind at the time of his death.

Shimei Nyong’o had not written a will at the time of his death nearly 20 years ago.

Court papers say that upon the senior Nyong’o’s death, Prof Nyong’o and his sister, Mrs Nyagoy, applied to be the administrators of his estate.

This was after the local chief certified that those listed in the application, including the governor and his mother were the rightful beneficiaries.

The respondents, however, claim that the applicants, who were awarded the grant, left out two people from the list of beneficiaries.

The petitioners claim that the governor and his sister (Dr Nyagoy) neglected the children of the late Margaret Awuor Dick (deceased) and Judith Nyong’o,  who were daughters of the late Hesbon and siblings to the governor.

Besides, the petitioners accuse the administrators of concealing material facts while seeking confirmation of the grant and not fully accounting for senior Nyong’o’s estate.

They now want the court to revoke or annul the grant of letters of administration to Prof Nyong’o and Dr Nyagoy.

“We want our late mothers to also have their equal share of the same like the rest and also the administrators to render books of accounts on how they have always managed affairs,” Mr Omondi says in an affidavit before court.

He further wants an audit done so that what was due to everyone is given to him or her.

Mr Omondi filed the case, which has been certified as urgent, fearing that Prof Nyong’o could sell, transfer and waste or otherwise detrimentally deal with the deceased’s estate.

An inter-parties hearing of the application, Succession cause number 815 of 2010, dated November 14, is fixed for November 29, the same day the hearing of an election petition filed by former Kisumu governor Jack Ranguma against Prof Nyong’o resumes.

Mr Ranguma is contesting Prof Nyong’o’s victory in the Kisumu governorship contest in the August 8 General Election.
