Three in court to oust Nyeri executives

Three Nairobi residents on Wednesday moved to court to challenge the retention in office of Nyeri County Executive Committee (CEC) members appointed by former governor Nderitu Gachagua.

Benard Ngiri, Denning Omungo and Catherine Wangui argued that following the death of Mr Gachagua at London’s Royal Marsden Hospital after succumbing to pancreatic cancer on February 24, the six CECs ceased to hold office.

The three faulted the current governor Samuel Wamathai for ignoring the provisions of the law and allowing the executives to continue serving in their positions without approval of the Nyeri county assembly.

“The Constitution provides that in the event a vacancy occurs in the office of the County Governor, then members of the County Executive Committee cease to hold office,” they said.

They alleged that the Nyeri governor has been misadvised to keep the committee in office instead of making new appointments.

The three want an order issued barring Dr Charles Githinji, Stanely Miano, Lucy Wanyitu, Robert Thuo, Timothy Ngunyangi and Erastus Karanja from holding office.

High Court judge Enoch Chacha Mwita has certified the case as urgent and directed that the matter be transferred to Nyeri.
