Michael Mubea, the commission’s deputy secretary, told the National Assembly’s Health Committee that the file on Clinix would be forwarded to the Director of Public Prosecutions Keriako Tobiko for action in the next two weeks.
He told MPs that the commission had requested all the court pleadings in the cases currently facing Meridian top officials and former NHIF chief executive officer Richard Kerich to commence the process of recovering the money.
Both Clinix and Meridian were suspended from the list of service providers when it emerged that the companies were allocated money for clinics that were non-existent at the time.
The providers were to offer medical services to civil servants and members of the disciplined forces.
“The recovery of assets acquired through corrupt means is part of the commission’s mandate,” Mr Mubea told the committee chaired by Rachel Nyamai (Kitui South).
A former chief executive officer, two directors of Meridian and others have been charged in connection with the loss of public funds.
Dr Peter Wambugu and Dr Ndiba Wairioko, who were charged alongside Mr Kerich, have since moved to court seeking to be removed from the case and be paid Sh118 million.
Mr Mubea told MPs that the commission will be taking to court the directors of Clinix.
“We will take all those who were involved in the loss of public money to court, even the Clinix directors,” Mr Mubea said.
He said investigations into the matter took too long because of the reconstitution of the Ethics and Anti-Corruption Commission where former director Patrick Lumumba was removed from office.
“The NHIF is among institutions that the commission has resolved to put on a corruption watch list,” he said.
Committee members expressed concerns over delays in the conclusion of the case and wondered why a George Jalang’o Midiwo, one of the NHIF employees named in the scam is still holding office.
“I’m surprised that he is still in office. I wish the Cabinet Secretary was here because he would have taken up the matter. Such a person should not be in office,’’ Mr Mubea told the committee.
