DPP accused of Rotich case delay

Director of Public Prosecutions Noordin Haji is yet to amend the charge sheet against former Treasury CS Henry Rotich and others implicated in the Arror and Kimwarer dams to reflect turning the former PS Kamau Thugge to a State witness from an accused.

Appearing before chief magistrate Monday, the prosecution said the new charge sheet and witness statements will be ready in two weeks.

The DPP dropped charges against Dr Thugge and former Wildlife PS Susan Koech, who will now be State witnesses against Mr Rotich and other accused persons.

At the same time, defence lawyers in the case protested the delay in the start of the trial and accused the DPP of violating their rights by seeking adjournments since 2019.

Lawyers Kioko Kilukumi and Katwa Kigen also said the DPP was yet to make full disclosure on the documentary evidence.

According to them, the DPP is violating the accused persons’ rights to a fair hearing.

They questioned the rationale of opening the criminal case and charging the accused when the DPP is not ready to prosecute the matter.

They raised the complaint after the DPP asked to be granted two weeks to furnish the defence with all documentary evidence that the prosecution side intends to rely on during the trial.
