Russian company OJSC Power Machines has asked the High Court to consider KenGen’s termination of a Sh52 billion tender for the supply of geothermal wellheads before delivering its judgment next month.

Power Machines wants Justice George Odunga to re-open its case against the power generator and consider as evidence a letter cancelling the award of the deal to local firm RentCo East Africa.

The Russian firm in its suit says RentCo forged its books of accounts to meet the minimum three year experience requirement required by KenGen. Power Machines says KenGen knew the documents were forged when it awarded RentCo the deal.

KenGen cancelled the contract on November 9 through a letter to RentCo, citing inconsistency in documents the local firm used to bag the deal.
