DPP says his secretariat will handle election-related cases for 24 hours from on Wednesday.
Director of Public Prosecutions (DPP) Keriako Tobiko has directed that those arrested for disrupting tomorrow’s repeat presidential poll and for malpractices in the wake of the vote be denied bail.
Mr Tobiko said on Tuesday that his secretariat will handle election-related cases for 24 hours from today to November 2 when the stringent bail terms will apply.
The period will cover the voting date and the seven-day window when the election board is expected to announce the results of the repeat vote.
Opposition leader Raila Odinga is boycotting the repeat election and has called for protests against the vote, arguing it will not be free and fair.
Mr Odinga had earlier urged his supporters to ensure the repeat poll did not take place, but yesterday he urged for peaceful protests.
Mr Tobiko on Tuesday said those engaging in violence, incitement to violence, hate speech and threats with intention to disrupt the elections will be apprehended and presented before relevant magistrate courts.
“In all such cases taken to Court, the release of the accused persons on bail or bond should be strenuously opposed,” Mr Tobiko said in a letter to Inspector General of Police Joseph Boinnet on Tuesday.
“The investigating officer shall therefore get in touch with the relevant prosecutors to prepare affidavit in opposition to bail/bond.”
The letter stamped “urgent” listed names and phone numbers of county heads at the office of the director of public prosecutions to be contacted between today and November 2.
