Court gives go-ahead for NSSF tower

The High Court has given the National Social Security Fund (NSSF) the green light to continue with its intended expansion of Hazina Towers, which houses Nakumatt supermarket.

Justice Lucy Gacheru made the decision in a suit in which the supermarket chain is seeking to stop the construction of additional floors on the building.

NSSF had put in an application to lift the order stopping construction.

The pension scheme owns the eight-storey building, and intends to add 31 floors in an expansion project.

Nakumatt is, however, opposed to the construction, arguing that it has disrupted business in the complex.

Justice Gacheru argued that she could not grant an extension to the interim orders without NSSF’s consent.

She also agreed with NSSF’s argument that the restraining orders were the subject of the main suit, and that granting the orders would be tantamount to determining the main suit while it is still at the hearing stage.
