Equity Bank chairman Peter Munga and fruit juice processor Del Monte Kenya are fighting over ownership of 75 acres of land in a row that could derail the businessman’s plan to open a girls’ school in Thika next month.

Del Monte in a notice says the tycoon has encroached on its land, adding that the matter was the subject of a court fight.

Mr Munga expected the girls’ secondary school known Pioneer Girls Thika to have its first intake in January next year.

“This property is the subject of court proceedings instituted by Del Monte Kenya against the Pioneer International School Limited for an unlawful trespass onto its property,” says Del Monte in notices published on Wednesday.

“Pioneer Group’s plan to start the school have come under question as result of the legal proceedings.”

Del Monte is also facing the biggest threat to its business after Murang’a and Kiambu counties declined to renew its land leases.

The fruit processor has sued the two counties, arguing that thousands of jobs and investments worth billions of shillings are at risk.

Kiambu and Murang’a counties have, however, opposed Del Monte’s application saying the company is not benefiting the local community in any way.

The counties have accused the company of poor working conditions, intimidating trade unions and discrimination in promotions and remuneration of workers.

Del Monte grows pineapples as its principal business and owns a large parcel of land extending between Murang’a and Kiambu counties.

Mr Munga in an early December interview said the school will be enrolling Form One and Form Two students, with facilities to accommodate 700 students. It is targeting middle class and upper middle class parents.

Mr Munga is the founder of the 15-year-old Pioneer High School in Murang’a, which has a student population of 1,500.

Mr Munga also owns St Paul’s Thomas Academy and is the chairman of Nairobi-based Pioneer International University.
