The Directorate of Criminal Investigations (DCI) has been blocked from summoning any official of Nairobi Hospital over the ongoing leadership and management fight at the premier facility.
High Court Judge Nixon Sifuna said although he had suspended any other applications pending the determination of contempt proceedings before him, the court has to protect parties involved in the matter from harassment and intimidation.
“Pending the hearing and determination of the application, an interim order of injunction is hereby issued, restraining and forbidding the DCI, its director as well as all the officers under his command, from summoning, threatening, questioning, detain or in any way, interfering with the peace and liberty of any persons as are parties on witnesses in this suit,” said the judge.
The judge also suspended summons issued to Dr Job Obwaka, a Dr Otieno and Mr Herman Manyora on August 27, 2025.
The judge directed the application to be mentioned on September 23, for further directions.
In the application to be heard later this month, Justice Sifuna found the ousted chairman Barcley Onyambu, the hospital’s chief executive officer Felix Osano and Gilbert Nyamweya (company secretary) in contempt of court, after proceeding with a retreat in Naivasha in July, despite being stopped.
The retreat was held on July 3 and 4, in Naivasha, but the trio claimed they suspended the meeting after being served with the court order.
Dr Onyambu argued that those who attended the retreat abandoned the agenda in its entirety, after being served with the court order and the only issue that the board considered was the court case. He submitted that the case stopping the retreat was filed without the authority of the company.
In a ruling last month, the judge rejected the argument and said the decision by the board was a clear scheme to circumvent, undermine and defeat the court order.
