CDF tops list of graft files taken to Tobiko

The Ethics and Anti-Corruption Commission (EACC) has submitted 141 files to the Director of Public Prosecutions (DPP) Keriako Tobiko for action.

In its annual report to Parliament, EACC said 108 files are being prosecuted while nine will be investigated further.

The bulk of the files involve allegations of embezzled Constituency Development Fund and soliciting of bribes.

Mr Tobiko has directed administrative or other action on seven files that were forwarded to him by the commission.

The EACC has closed 17 files as directed by the DPP during the year ending December 31, 2011.

Finance minister Njeru Githae tabled the report on Thursday last week. Some of the affected constituencies are Rongo, Igembe South, Ganze, South Mugirango and Rangwe.

Procurement procedures

Investigations in the Igembe South case showed that the CDF committee paid a contractor Sh4.1 million without the interim payment certificate.

“When the works undertaken by the contractor were evaluated, it was discovered that he had been paid for incomplete works and that a sum of Sh1.8 million was paid for works not done,” the report indicates.

Fund account manager for Ganze CDF took a Sh300,000 imprest for facilitating the exercise of a baseline survey of all CDF projects.
West Mugirango MP James Gesami was charged with failure to comply with procurement procedures and engaging in a project without planning by unilaterally awarding Sh2.5 million to construct a road that was not approved by CDF committee.

Some of the files closed include the Western Kenya Community Driven Development and Flood Mitigation Project involving Sh0.94 million and one on the Igembe South MP Mithika Linturi who was accused of irregularly purchasing a constituency vehicle at Sh4.2 million, said to have led to a loss. They were closed for lack of evidence.
