Farmers oppose Nzoia Sugar MD’s term extension

Three sugarcane farmers have gone to court seeking to stop the extension of the term of office for managing director of Nzoia Sugar Company Saul Wasilwa.

Douglas Barasa, Collins Wafula Makunja and Richard Wamalwa Makhino want the High Court to reverse a decision made by the Agriculture, Livestock and Fisheries Principal Secretary extending Mr Wasilwa’s term by six months.

The trio has also sued the chairman and board of directors of the sugar company over what they term as an illegal move.

“As farmers attached to Nzoia Sugar Company we are concerned about the irregularities which will affect and has already affected our livelihoods and we seek the court’s intervention,” they said.

According to papers filed the extension was made in a letter from the PS dated May 4. The letter addressed to the sugar firm’s chairman Joash Wamang’oli extended Mr Wasilwa’s term as the managing director for another six months.

Mr Wasilwa was serving a second term that was due to expire on May 19 when the principal secretary announced the extension.

He was first appointed the managing director for a three-year term in May 2009 and had his term extended in February 2012 through a gazette notice issued three months before expiry.

The farmers say the principal secretary has no powers under the State Corporations Act to make such extensions.

The three said in court documents that the assertion that the PS’s decision was informed by an evaluation report done by the board of the company on January 9 was false as no board existed at the time.

“Nzoia Sugar Company Limited has been without a board for about two years and the same was only been appointed on April 17 and therefore there can have never been any evaluation on his performance by the board,” they said.
