MPs set to have a say in impeaching governors

MPs will play a role in the impeachment of governors and their deputies if a Bill published by Eldas MP Adan Keynan becomes law.

Mr Keynan wants the County Government Act amended to shield the two officers from politically instigated schemes sponsored by vested interests through MCAs.

The Constitution empowers members of county assemblies (MCAs) to initiate impeachment of a governor and once successful the Speaker of the assembly presents the proceedings to the Senate for final say.

Last week, Senators rejected the impeachment of Machakos deputy governor Bernard Kiala who had been sent packing on grounds of violating the cohesion law and abuse of office.

This was the second time that the Senate is throwing out impeachment proceedings. The first was when Kericho governor Paul Chepkwony was thrown out.

Embu governor Martin Wambora is fighting his impeachment at the Court of Appeal after the Senate upheld his removal from office twice.

Through the County Government (Amendment) Bill 2014, Mr Keynan seeks to empower the National Assembly to review the conduct of a State officer in the impeachment proceedings.

The Bill allows any Kenyan to petition either House for the removal of a governor on grounds provided under the Constitution.

Said Mr Keynan: “This Bill articulates the right conferred on members of the public to petition Parliament on any matter within their authority in line with the Constitution.”

The public can also submit views to the special team handling impeachment.
