Contractors wrangle over Sh522m JKIA deal

Tanzanian firm Weld-Con Limited is entangled in a court battle with China’s Catic and the Kenya Airports Authority (KAA) over a Sh522 million contract for various works done at the Jomo Kenyatta International Airport (JKIA).

Weld-Con has sued Catic, a subsidiary of Avic International, and the KAA for delaying Sh145 million it was to receive after completion of subcontracted works at JKIA.

The Tanzanian firm claims that Catic and KAA have failed to settle its debt despite there being no complaints over the works it did at JKIA.

But Catic in the same suit has filed a claim of Sh522 million against the KAA, arguing that it is yet to receive a cent from the authority.
Part of the Sh522 million Catic is claiming from the KAA is intended to settle Weld-Con’s dues.

Weld-Con says it supplied and installed a fuel hydrant emergency shutdown system that has not generated any complaints from the KAA and Catic, and that the product is already in use at the JKIA.

“Weld-Con completed all the sub-contracted works and demobilised from the site in May, 2015 having made the final application for payment,” says Weld-Con.

The three parties however told Justice Louis Onguto on Monday they are negotiating out of court and could be ready to record a settlement on May 10 when the judge will mention the case.
