Matiang’i in trouble over varsities board hirings

Education CS Fred Matiang’i has been put on the spot for advertising vacancies in the boards or councils of public universities despite a court order stopping the process in March, last year.

Dr Matiang’i has advertised the vacancies on the Education ministry’s website in the quest to fill the positions of chairperson and board members in 21 public universities.

The notice come months after the Employment and Labour Relations Court judge Nelson Abuodha suspended the recruitment process pending the hearing and determination of a petition before the court.

Activist Okiya Omtatah, who filed the petition, has now filed an application asking the judge to find Dr Matiang’i in contempt of court.

He wants the CS jailed for six months and the advertisement by the minister quashed.

Dr Matiang’i dissolved all public university councils in January last year in a bid to have them reconstituted in line with the law, which provides that the CS shall make appointments after an open and fair process.

“The adverts are in utter contempt of the orders this court issued on March 10, 2016, prohibiting the recruitment of persons to fill vacancies in governing councils of public universities and of their constituent colleges pending the hearing and determination of the petition.”

“The petition has been heard and is awaiting judgment before the honourable Justice Nduma Nderi. Dr Matiang’i fully participated in the proceedings where he was represented by the Attorney-General,” says Mr Omtatah.
