House Speaker Justin Muturi will rule on whether the Senate has power to investigate the financial woes facing national carrier Kenya Airways after MPs complained of encroachment of their mandate by Senators.

In what could trigger another round of a power struggle between the Senate and the National Assembly, Mr Muturi said he would rule on a request by Ainabkoi MP Samuel Chepkonga.

The Senate and the National Assembly have previously been engaged in turf wars that ended in the Supreme Court.

Tuesday, MPs demanded that the Speaker directs that the matter be taken to the Supreme Court for clear demarcation of roles between the MPs and the senators.

The MPs who contributed to the debate threatened to institute amendments to the Constitution to disband the Senate, which they said has no work.

“Kenyans are at liberty to take the decision they want on the Senate. But I will do consultation to see if we can resolve the emerging difficulties or differences. I reserve my ruling to a later date,” Mr Muturi told MPs.

Mr Chepkonga had sought to know why KQ management, Transport and Treasury cabinet secretaries were being summoned to the Senate over woes facing the airline instead of appearing before the National Assembly Committee on Transport.

He accused the Senate of overstepping its mandate by encroaching into the purview of the National Assembly which plays the oversight role of all State organs.

“There are certain matters that have acquired national notoriety. KQ has been going through a lot of turbulence. This is a matter of concern to National Assembly,” said Mr Chepkonga.

“It is surprising that this matter has found its way into the Senate in very unclear circumstances.

“I am not rising to discuss the Senate but duplication of functions between the two Houses,” he said.
