Retired president Daniel arap Moi ordered the take-over of a private beach hotel in Mombasa, the appeal court heard on Thursday.
Kinyua Kamundi, the counsel for African Safari Club, said the leisure group could not file tax returns for Flamingo Beach hotel after it was taken over by the police.
Mr Kamundi said ASC had not been able to access the movable assets, documents and computer records of the hotel since it was denied entry last year.
The Retired president Daniel Arap Moi has been drawn into the legal dispute involving the hotel chain and several state officers who allegedly took over the hotel.
Mr Kamundi told the court that the High Court declined to grant orders to have the ‘invaders’ removed from the hotel. African Safari Club has sued the Commissioner of Police, Permanent Secretary in Internal Security, Bisam Security company, Business Security Company and advocate Juma Kiplenge.
The appellant told Justices Onyango Otieno, Alnashir Visram and Martha Koome that Mr Kiplenge had said the police had taken over the hotel, without a court order, in compliance with orders from the retired president.
“Some people had said that Moi had taken over the hotel. When Mr Kiplenge filed his affidavit, he did not deny that he had been ordered by Mr Moi to take over the hotel,” Mr Kinyua said.
The judges are expected to deliver their ruling next week on Thursday.
