Slain tycoon’s widow takes battle for his Sh5b estate to court

The family of slain Mombasa tycoon Shahid Pervez Butt who owned Modern Coast bus service company has taken the battle for control of his Sh5 billion estate to court. Mrs Regine Butt, the deceased’s wife and her mother, Roselinde Gudrun Ostertag, have petitioned the court to grant them letters of administration to the tycoon’s estate until a long-term administrator is found.

Mrs Regine Butt is also seeking to be paid Sh1.5 million monthly from bank accounts, incomes and profits of Modern Coast Express Limited and Vantage Road Transporters Limited for upkeep and maintenance. According to the suit filed at the High Court in Mombasa, Mrs Regine Butt is also seeking to be paid Sh1.05 million each year from the two companies for school fees of her two children.

The petitioners are also seeking an order prohibiting the deceased’s son Haroon Shahid and his mother Akhtar Shahid Butt from drawing monies from various accounts and selling, transferring, disposing of, leasing and dealing in several plots. The two have been named as interested parties in the suit.

Mr Butt was gunned down on July 11 this year in Changamwe. Mrs Regine Butt and her mother said they would administer all the estate of the deceased, which by law is managed by his personal representatives for use and benefit of dependants. The widow wants limited grant of letters of administration for the purpose of collection, preservation and receiving the deceased’s assets to make limited provisions for the upkeep, maintenance, education and transport for herself and children.

Among the assets listed in the petition by the widow include shares in the family businesses Modern Coast Express Limited, Vantage Road Transporters, Blue Bell Properties and several parcels of land among others.

Mrs Regine Butt and her mother said they were legal dependants and beneficiaries of the deceased’s estate hence entitled to the grant of letters of administration.

“The petitioners are in the process of petitioning for full grants of letters of administration intestate in their joint names,” reads part of the petition. The petitioners are also seeking an order to be issued to financial institutions to furnish them with statements of accounts of the deceased for purposes of taking an inventory of his assets.
