Court fails to rule on Badi Cabinet sittings petition

Nairobi Metropolitan Services (NMS) director-general Mohammed Badi will continue attending Cabinet sittings after the High Court failed to issue an interim order suspending President Uhuru Kenyatta’s decision to co-opt him.

When a petition challenging the President’s decision was called for hearing Tuesday, Justice Anthony Mrima instead directed the parties to file and exchange their written arguments.

The petitioner, Kandara MP Alice Wahome, moved to court in September seeking orders barring Major-General Badi from attending Cabinet meetings on grounds that he is a stranger to the Cabinet and the President failed to involve Parliament in the appointment.

Justice Mrima heard that the MP had not filed her written arguments as directed earlier on October 6.

Ms Wahome’s lawyer, Stephen Gitonga, had also not furnished the Attorney General and the NMS boss with documents containing the written arguments.

As a result, the judge directed the lawyer to furnish the respondents — Attorney General and Major Badi — with the documents within three days.

The respondents will put their responses to the petition within seven days.
