Proprietors of Jack & Jill supermarket in Nairobi will wait longer before receiving Sh21.5 million they were awarded by a court for the illegal demolition of the iconic retail shop seven years ago.

High Court in Nairobi has allowed a request by the retailer’s former landlord Viktar Maina Ngunjiri to settle the compensation, which has increased to Sh30 million due to interest and legal costs, on monthly installments.

Justice Joseph Sergon told Mr Ngunjiri to be paying the supermarket a sum of Sh1,250,000 every month with effect from November 10, 2020 and on the tenth day of each succeeding month until full payment.

The judge said the debt should be settled within 24 months.

Mr Ngunjiri was on October 25, 2018 ordered to pay the retailer damages of Sh21.5 million for the illegal demolition of building on May 2013. It took place when there was a court order restraining the landlord from evicting the plaintiff.

While urging court to allow the monthly installments, Mr Ngunjiri said his business of export and import has been badly hit.

Mr Nginjiri said he imports and exports commodity, mainly trading with China.

Justice Sergon heard that the current Covid-19 pandemic has affected Mr Ngunjiri’s business to the point that he is unable to raise enough funds to settle the decree at once.

He had asked the court to allow him to settle the decree by monthly installments of Sh500,000, however, the judge declined the proposal on grounds that it would be oppressive to the plaintiff.
