Judiciary settles Sh4.5bn cases through mediation

More than 2,000 cases worth more than Sh4.5 billion have been settled through mediation guided by courts in a bid to conclude speedily.

The Judiciary said it settled 2,239 cases through Court Annexed Mediation (CAM) that were done virtually in the wake Covid-19 that disrupted in-court sessions.

The CAM is a process where parties pick an arbitrator to determine their cases amicably and it was meant to handle 3,589 cases from last year.

Where parties reach agreement, they may record a settlement agreement, before it is forwarded to court for adoption as an order.

But where parties fail to reach settlement, the file is forwarded to court for the hearing before a magistrate or judge.

CAM was established in 2016 as a pilot in the Family and Commercial and Tax Divisions of the High Court at Milimani and later rolled out to other divisions and stations.

Mediation Deputy Registrar Caroline Kendagor said CAM was operational in 14 court stations with seven so far implementing virtual dispute resolution including Tononoka, Mombasa, Eldoret, Kisii, Kisumu, Nyeri and Machakos law courts.
