Kamotho son denies forgery claims suit in fight for estate

A son of Kanu-era Cabinet minister Joseph Kamotho was on Wednesday charged at a Nairobi court over alleged forgery of documents in order to disinherit his siblings, as a feud on distribution of the late politician’s multi-million shilling wealth escalates.

Charles Githi Kamotho appeared before Milimani Chief Magistrate Wendy Kagendo and denied the criminal charges levelled against him.

He denied forging a doctor's report alleging that his sister Marianne Nyokabi was of unsound mind hence not fit to be administrator of the estate.

"On October 12, 2015 at unknown place within the Republic of Kenya with intent to defraud forged a medical report for Marianne Nyokabi Kamotho purporting it to be a genuine medical report made and signed by Dr Mucheru Wangombe," reads the charge sheet in the first count.

In the second count, Mr Githii was charged with presenting the forged medical report at the Deputy Registrar of Milimani High Court in a succession case.

The arraignment and prosecution of Mr Githi comes after the Directorate of Criminal Investigations (DCI) forensic unit established that the letter by the doctor was fake.

He pleaded not guilty to the charges and was released on a bond of Sh300,000 or cash bail of Sh150,000 pending the hearing of the case.

The court dismissed a request to defer the plea-taking to enable Mr Githii resolve the matter out of court.

The elder Kamotho died on December 6, 2014 in a hospital in South Africa and left his widow Eunice Wambui Kamotho and four children--Charles Githii Kamotho, James Mwai Kamotho, Marianne Nyokabi Kamotho and David Waweru Kamotho.

The property Mr Kamotho left behind include five parcels of land at Gacharage Murang’a, land in Kakuzi Murang’a, a house at Jadenville Country Homes and a matrimonial house at Kitisuru Nairobi.

The former minister also had shares in Safaricom, KenGen, Britam, Barclays, Sameer Africa, and had a bank account at Standard Bank.
