Sonko suffers setback in bid to halt IEBC vote call

Impeached Nairobi governor Mike Sonko has suffered a setback after the High Court failed to stop the Independent Electoral and Boundaries Commission (IEBC) from calling and conducting a by-election scheduled for February 18, 2021.

Mr Sonko wanted the court to issue an ex-parte order restraining the IEBC from publishing in the Kenya Gazette, electronic and the print media a Notice of holding elections of governor’s seat for Nairobi City County as a result of the resolutions passed by the Senate last week.

However, Justice James Makau directed Mr Sonko's lawyers to furnish the polls agency and the other respondents in the case with copies of the petition so that they can respond to his claims.

The judge further directed that the respondents, who include the Senate and the county assembly, to file their responses and submissions within 15 days.

The court fixed hearing of the case on February 3, 2021.
