The High Court has declined to temporarily suspend sections of the Affordable Housing Act including the collection of the housing levy, stating that public interest tilted in favour of allowing the law to operate until the petitions are decided.
A bench of three judges said that laws enacted by Parliament enjoy the presumption of constitutionality and the court cannot stop them unless it is demonstrated that there is a risk of being violated.
