Former KICC bosses face prosecution in flawed WTO tenders

A special audit has recommended the prosecution of former Kenyatta International Convention Centre (KICC) managing director Fred Simiyu, then acting managing director Joel Terer and head of procurement Charles Makoko for irregular procurement of goods during the World Trade Organisation (WTO) projects.

Auditor-General Edward Ouko accuses the KICC of procuring goods and services for the WTO Inter-ministerial Conference in a chaotic manner and in total disregard of the Public Procurement and Public Finance Management laws.

Mr Ouko wants Mr Simiyu held to account for Sh496,897,072 that was irregularly awarded if found culpable in flouting the procurement and public financial management laws.

He has recommended that Mr Makoko, the former head of procurement, to face legal action for the loss of Sh510,405,559 while Mr Terer is to face trial over Sh13,508,480 tenders.

Mr Ouko has also accused the KICC board of directors of direct involvement in the flawed procurement processes where they participated in the revision of the cost of design, supply and installation of computerised conference management system tender.

“The tender committee was not procedurally constituted in compliance with the second schedule of the Public Procurement and Disposal Regulations 2016,” Mr Ouko says in an audit sanctioned by the KICC management in respect of projects and pending bills for the conference that was held in 2015.

“In most cases, the tender committee was not involved in the procurement process.”
