NIC Bank bosses want suit dismissed

Top managers of a city bank cited for contempt of court have asked the High Court to strike out the suit.

NIC Bank Kenya #ticker:NIC Group Managing Director John Gachora and other top managers have asked the court to reject a case against them filed by lawyer William Kipkorir Arusei.

In the preliminary objection filed on January 29, through Muriu Mungai & Company Advocates, the managers say the laws which mandated the court to punish alleged contemnors have been repealed and the case filed against them is defective. They say Mr Arusei has no legal right to institute contempt proceedings in the absence of a valid court order issued in his favour.

Mr Arusei has cited the managers for defying a court order that they release to him a Sh8.2 million vehicle after paying the bank Sh500,000.

The case will be heard on February 26.
