A private wildlife conservancy has been ordered to pay its former finance manager Sh9.2 million for wrongful dismissal in a precedent-setting court case that touches on nepotism and racial discrimination.
Appellate judges Philip Waki, Milton Makhandia and Kathurima M’Inoti upheld a decision by the Employment and Labour Relations Court that David Wanjau Muhoro was discriminated against and directed he be compensated Sh7,500,000 in cumulative pay disparity and Sh1,744,542 in damages for discrimination.
Labour Relations judge James Rika had on September 16, 2014, ordered Ol Pejeta Ranching Limited to pay Mr Muhoro Sh21,746,031 in terminal dues of which Sh3,489.084 was compensation for pay disparity.
The Court of Appeal judges, however, slashed by Sh11,481,489 the award pronounced by Mr Justice Rika.
He said Ol Pejeta, the 90,000-acre conservancy in Laikipia County that is East Africa’s largest black rhino sanctuary and home to orphaned and rescued chimpanzees, “practised nepotism and racial discrimination against black managers”.
