AG wants KPA boss sacking case dismissed

The Attorney-General wants a case filed by activist Okiya Omtatah challenging the sacking of former Kenya Ports Authority's chief executive, Catherine Mturi-Wairi, dismissed.

Through Principal State Counsel Nguyo Wachira, the AG says that hearing the suit after Mturi-Wairi resigned from her position would amount to a waste of time.

“In view of these facts the petitioner’s rights and interest, if any, are extinguished and settled in law, any further hearing shall be a waste of time,” said Mr Wachira.

On Thursday, Justice James Rika of the Employment and Labour Relations Court in Mombasa said Mr Omtatah may serve his amended petition to the KPA board of directors and the AG.

The court was told that Mr Omtatah intends to alter his petition in relation to what has transpired since the case was lodged.

In his application, Mr Omtatah had sought an order prohibiting the KPA board and AG from effecting the decision to sack Ms Wairi and replace her with Daniel Manduku in an acting capacity.

The activist argued the changes were a nullity in law having been made by a board meeting that lacked a quorum and which had been infiltrated by strangers.
