CA, ministry now blame police for blocking Wangusi

The Communications Authority of Kenya (CA) and ICT ministry have shifted the blame on blocking Francis Wangusi from accessing his office after the court overturned his suspension as the telco regulator director-general.

The board now claims Mr Wangusi was blocked from entering the authority headquarters by plain clothes police officers.

The CA board sent Mr Wangusi on a three-month compulsory leave on January 12, arguing they needed him out of office to allow an independent audit on the regulator’s hiring processes.

He moved to court and obtained an order reinstating him to the job.

But he has accused the CA board and the ICT ministry of defying the directive and locking him out of office, prompting the contempt suit.

“I am informed that…the National Police Service officers barred the petitioner from accessing the 1st respondent’s premises,” says Christopher Guyo Huka, in an affidavit sworn on behalf of other members.

Mr Huka says Mr Wangusi was blocked on February 1 from accessing the office by police officers.

The Authority says the police officers arrived at the premises at 5.30am and took over the clearance of visitors at the Waiyaki Way office. They allegedly identified themselves as officers from police headquarters who were on a “security operation entailing strict security enhancement and access by authorised people and properly cleared visitors and clients”.

The officers allegedly blocked Mr Wangusi when he tried to access the building late in the afternoon.

The regulator says Mr Wangusi didn’t show up until February 6, when he accessed his office and was issued with a letter recalling him to office.

Mr Wangusi allegedly requested to proceed on leave until February 28.

Mr Wangusi filed the contempt proceedings a day later, which Mr Huka terms as abuse of court process.

On his part Mr Joe Mucheru has distanced himself from the allegations, arguing that his office is not based at the CA’s office and that he is not involved in the operation of its affairs.
