DPP vows to lock out graft suspects from office

Director of Public Prosecutions (DPP) Noordin Haji has vowed to take his battle for the removal of State officers charged with graft from office to the Supreme Court.

Mr Haji said the officials' stay in office was an affront to the fight against graft and has seen the suspects interfere with investigations.

The DPP’s court bid to bar National Land Commission chairman Muhammad Swazuri from returning to office despite graft charges was unsuccessful.

A positive ruling for the prosecution could have a bearing on other State officers facing criminal charges such as Migori governor Okoth Obado and his Busia counterpart Sospeter Ojamong, who could have been forced to vacate office until their cases are heard and determined.

“I have been fighting that these people we are investigating to step aside. We will continue to fight it and even go to the Supreme Court,” Mr Haji said.

Speaking at the Bomas of Kenya during the first day of the national anti-corruption conference at the Bomas of Kenya, the DPP singled out the two governors who have been charged with corruption and murder and are still in office.

“The other day we charged the governors but they are in office and we see them firing people. Others came back to office and a computer disappeared,” Mr Haji said.

Last year November, the DPP told the courts to evoke chapter six of the Constitution that require such individuals to step aside until their matters were heard and determined.

The DPP reckons that allowing them in office while facing serious charges was discriminatory because other public officers, who are not constitutional office holders, are required to step aside.

Governor Ojaamong was arrested in July last year to answer charges of engaging in a project without proper planning, abuse of office, and wilful failure to comply with the law relating to management of funds.

It is alleged that Mr Ojaamong’ unilaterally signed a Memorandum of Understanding (MoU) with Madam R Enterprises (MRE), leading to a Sh8 million loss.

Mr Obado is charged with the murder of 26-year-old student Sharon Otieno and the ant-graft agency has accused him of irregular tenders worth Sh2 billion.

Swazuri was charged with fraud over land allocation for Mombasa-Nairobi SGR line.
