James Odhiambo was Monday fined Sh4.5 million for loss suffered by the Ministry of Education 11 years ago.
Mr Odhiambo was accused of giving false receipts to the ministry purporting that he had spent Sh2,263,440 for refurbishment at the Provincial Technical Training Eastern Province Office, Embu.
He was head of School Equipment and Maintenance Unit (SEMU) at the Education ministry.
A former Ministry of Education official James Odhiambo was Monday directed to pay Sh4.5 million or serve a year in jail for the loss suffered by the ministry 11 years ago.
Senior Principal Magistrate Felix Kombo Monday held that the evidence presented before court had proved beyond any reasonable doubt that the accused had forged documents which were used to defraud the ministry.
The charge had stated that on June 4, 2008 at Jogoo House, in Nairobi, being an agent of the Ministry of Education, he gave false receipts to the ministry purporting that he had spent Sh2,263,440 for refurbishment at the Provincial Technical Training Eastern Province Office, Embu. He was head of School Equipment and Maintenance Unit (SEMU) at the Education ministry.
“I find it proved beyond all reasonable doubt that the receipts, the subject of count one, were forged documents and therefore false,” SPM Kombo.
He said the documents were made by the accused who therefore knew that they were false.
“The accused gave them to his principal – the Ministry in purported account for the impress of Sh2,263,440 which he received through impress warrant number C806410,” said the magistrate.
The court noted that receipts by the accused were indeed forgeries and were never issued by the entities indicated on their face.
“They were written by the accused himself and only he would know their real source,” ruled the magistrate.
The accused was however acquitted on the second count, which also alleged fraud.
