Hotel Intercon under probe for discrimination

An employee of an international five star hotel has asked Parliament to intervene and end preferential treatment of foreign workers over locals, endemic discrimination and harassment.

Through a petition to the National Assembly filed by Suba MP John Mbadi, the petitioner accuses Hotel Intercontinental in Nairobi of violating Article 41 of the Constitution that guarantees every person the right to fair labour practices.

“I, the undersigned, on behalf of a concerned citizen draw the attention of the House there have been efforts to replace Mr Fred Ogutu, the director of Food and Beverages, with an expatriate, for no discernible reason contrary to the principles of fair administrative action,” said Mr Mbadi.

The petitioner further alleges that there has been endemic discrimination and harassment of local staff by the management, which has left workers with little recourse for action.

He said fair treatment of workers is a key component of social justice guided by the principles of non-discrimination as stipulated under Article 27 of the Constitution.

“These statutory requirements appear to have been flouted at the Hotel Intercontinental in Nairobi with regard to preferential treatment that appears to be exhibited towards foreign workers at the expense of locals in the organisation.
