Justice Chacha Mwita on Thursday found that the purported use of the public portal to advertise government achievements is unlawful and contrary to the Elections Act.
President Uhuru Kenyatta’s government has been unlawfully using public funds to advertise its achievements during the campaign period, the High Court ruled Thursday.
The finding means the State will no longer publish its achievements in a public portal or any form of media during the campaign period.
Justice Chacha Mwita found that the purported use of the public portal to advertise government achievements is unlawful and contrary to the Elections Act.
He consequently issued orders stopping the government from advertising any of its achievements in any form of media arguing it amounts to unlaful use of public resources.
“An order of permanent injunction is hereby issued restraining the national government ,whether by itself, agents, servants, proxies or any other person acting under its authority or direction to advertise achievements of any programmes or projects across in the past four years during the election period,” said Justice Mwita.
The judge said public resources must be used for the general welfare of the people of Kenya and must be safeguarded from violation.
Former Law Society of Kenya Chief executive Apollo Mboya had sued the State over the said adverts.
