Portland staff seek jail term for directors in Sh1.4bn pay row

The contract employees have filed an application at the Court of Appeal seeking to have the directors — Kungu Gatabaki, Sarone Ole Sena, Simon Peter Nkeri, Sheila Kawira Kahuki, and Joseph Kinyua — jailed for six months.

The workers argue that despite both the labour and appellate courts having directed that they be paid, the company directors have failed to comply. The Sh1.4 billion award is for over 400 workers of the cement manufacturer who were covered under the 2012-2015 collective bargaining agreement (CBA).

“Instead the directors have charged most of the EAPCC properties with Kenya Commercial Bank to defeat execution process,” the employees in court papers.

The workers further accuse the directors of engaging them in endless litigation and resorting to dismissing contract employees to avoid liability for the implementation of the CBA.
