What you need to know:

  • The public land administrator has also ordered Alliance Hotels to forfeit its Kilifi land to Mohamed Mbaruku and Ali Mohamed Heri, Hamii Ayub, and Omar Bakari.
  • Nairobi’s Eastleigh Market plot has reverted to the Nairobi County Government which will set up a public market on it.

Listed cement-maker Athi River Mining #ticker:ARM is among a number of companies set to lose property following determination of disputes lodged with the National Land Commission (NLC).

The company, listed as ARM Cement Plc., will have its Kilifi title deed revoked and a fresh one issued to Abdurhaman Omar Yunus Bashir. The public land administrator has also ordered Alliance Hotels to forfeit its Kilifi land to Mohamed Mbaruku and Ali Mohamed Heri, Hamii Ayub, and Omar Bakari.

Kaab Investments’ ownership of 6,268 acres in Lamu was equally revoked. The firm has been at the centre of the multibillion TSS firms’ controversy in which several people have been taken to court for allegedly obtaining billions of shillings from the companies owned by the late billionaire, Tahir Sheikh Said, mainly through bank guarantees.

The dispute over the ownership of Nairobi’s Eastleigh Market plot where a multi-million shillings property is under construction has also been determined over the ownership by Ali Sheikh Mohamed and Farah Mohamed’s annulled. The plot has reverted to the Nairobi County Government which will set up a public market on it.

Fidelity (now SBM) Bank and Dubai Bank (in liquidation) were ordered to discharge titles held as security for loans. The titles were awarded to Nairobi County for Muguga Green Estate play area and South Eastern University (SEKU) respectively.

Safeway Hypermarket and four oil companies, including Oilibya and Gulf Energy, have had their documents revoked with the land reverting to the national government road agencies.

The National Social Security Fund (NSSF) will refund money received from the Keiyo Teachers’ Savings society for sale of various plots in Eldoret belonging to the government and hence unavailable for allocation. At the same time county governments have ample land for development of housing units after numerous title-deeds and lease certificates issued to private individuals and companies were annulled.
