Court now shields former KAA acting boss from ‘humiliation’

The Employment and Labour Relations Court on Tuesday stopped disciplinary proceedings against former Kenya Airports Authority acting managing director Yatich Kangugo.

In an application certified as urgent by Justice Hellen Wasilwa, Mr Kangugo through lawyer Danstan Omari argued that the proceedings slated for this afternoon were meant to humiliate him. He argued that he has no confidence in the composition of the KAA disciplinary committee, save for the chairperson. He said they have been in a constant tug-of-war with him after he moved to court in October 2016, challenging his removal.

Mr Kangugo further alleged that he was fearful that the bias against him will not lead to a just outcome and if not stopped, the committee might end up humiliating him.

“That the 1st respondent’s disciplinary session slated for February 27, against the applicant herein is tantamount to a committee of hyenas presiding over the welfare of a goat,” he said in a sworn statement.

Mr Omari said senior management took issue with Mr Kangugo after he addressed members of staff who were protesting over the alleged plan to sell off Jomo Kenyatta International Airport.

Mr Kangugo said he was confronted by a group of angry and frustrated union officials and staff members who demanded to hear from him whether he was a part of a group of top management that wanted to sell JKIA.

He said the staff members were angered by the reality that the said takeover would render them redundant and therefore wished to hear from him.

The management later wrote to him demanding an explanation on why he should not be punished for allegedly being in breach of the Human Resource Manual.

He agreed that he had addressed the employees in an attempt to cool them down and give them hope that he would intercede on their behalf and save their livelihoods.

In the petition filed in 2016, Mr Kangugo accused the management of violating his rights as an employee.

Mr Kangugo accused management of exempting him from meetings despite the fact that he was a senior manager.
