Fresh campaign to remove Ouko lands in Parliament

Auditor-General Edward Ouko will know his fate in two weeks time after a fresh campaign to remove him from office landed in Parliament last evening.

This is after a petitioner Emmanuel Mwangambo Mwagonah filed a petition seeking to remove Mr Ouko for “serious violation of the Constitution.”

National Assembly Speaker Justin Muturi informed MPs that he had received a petition asking lawmakers to recommend to the President to appoint a tribunal to investigate Mr Ouko in line with provisions of Article 251 of the Constitution.

Mr Muturi referred the petition to the Finance, Planning and Trade Committee chaired by Ainamoi MP Benjamin Lang’at to review the charges and issue a report within the next 14 days.

“The petitioner contends that the Auditor-General has, inter alia, violated Article 201(d) regarding prudent and responsible use of public funds by allegedly failing to prevent wastage of public funds,” Mr Muturi said.

Mr Mwagonah accuses Mr Ouko of breaching Article 73(2)(b) of the Constitution by ignoring merit and the approved scheme of service in the recruitment and promotion of employees in the Office of the Auditor-General.

The petitioner further claimed that Mr Ouko had breached the Leadership and Integrity Act, alleging conflict of interest and the recruitment of some employees in 2015.

The petitioner heavily relies on a case in which Mr Ouko was alleged to have procured an audit vault software at an inflated cost of Sh100 million. This latest attempt, however comes barely a week after the Director of Public Prosecutions Keriako Tobiko cleared Mr Ouko of the corruption allegations.

He, however, authorised prosecution of eight individuals from Ouko’s office, OSI Kenya Ltd and Oracle Kenya.
