ATC Kenya Operations Limited also opposed the case arguing that the failure to acquire the requisite license for construction of the booster as claimed, was purely a matter within the jurisdiction of the Environment tribunal.

The High Court has dismissed a case brought by a Mandera resident seeking to block Airtel from constructing a telecommunications mast in Aresa town, arguing that it was a security threat and caused environmental pollution.

Mr Abdinasir Ibrahim Noor wanted the construction of the mast in Mandera East constituency halted arguing that the telco had failed to conduct public participation or carry out an environment impact assessment.
