Man faults presumption of KRA’s veracity in tax fights

A Nakuru medic has moved to court to challenge a section of the Tax Procedures Act that requires a taxpayer to prove that assessments conducted by the Kenya Revenue Authority (KRA) are incorrect.

Section 56(1) of the Tax Procedure Act places the burden of showing the KRA’s tax assessment decision as incorrect on the taxpayer as it is presumed that the assessment of the taxman is correct.
