Transport manager Abdul Kairo is reported to have fatally shot Stephen Wafula Musumbi (twice in the chest) on November 10, 2015 under unclear circumstances.
Prosecutor Catherine Mwaniki applied to have the suspect be detained for two weeks for the preliminary procedure.
Mr Kairo will return to court on July 18 to answer the capital charge.
'Unnecessary force'

When the suspect was arraigned before Lady Justice Jessie Lessit, she directed that the suspect be taken for a mental assessment at the Mathare Mental Hospital then be detained at the Industrial Area police station.
The retailer's head of security, Michael Ndung’u, was quoted in the media as alleging that the deceased - who appeared to be mentally disturbed - was chasing his colleagues while armed with a panga and spade.
One of the workers sustained a panga cut while the rest fled to safety.
